Terms of Service — OpinionDeck

1. Acceptance of Terms

By accessing or using OpinionDeck ("Service", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, users, and others who access or use the Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

OpinionDeck is a market intelligence platform that monitors public conversations on Reddit, Hacker News, and similar platforms. The Service uses AI to identify relevant discussions, surface competitor mentions, extract pain points, and help you understand what potential customers are looking for.

All content surfaced by OpinionDeck is drawn from publicly available data on third-party platforms. We do not create this content and make no warranty as to its accuracy, completeness, or fitness for any purpose.

3. Eligibility

You must be at least 18 years old to use the Service. By using OpinionDeck, you represent and warrant that:

You are at least 18 years of age;
You have the legal capacity to enter into a binding agreement;
All information you provide to us is accurate and complete; and
If using on behalf of a business, you are an authorised representative of that entity.

4. Account Registration & Security

Access to OpinionDeck requires authentication via Google Sign-In. You are responsible for maintaining the security of your Google account and for all activity that occurs under your OpinionDeck account.

You must notify us immediately at hello@opiniondeck.com if you suspect unauthorised access to or use of your account. We are not liable for any loss or damage arising from unauthorised use of your credentials.

You may not share account access with other individuals or create accounts on behalf of others without explicit written permission from us.

5. Subscription & Payment

OpinionDeck offers subscription plans billed on a recurring monthly or annual basis through Stripe. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis until you cancel.

Prices are displayed inclusive of applicable taxes where required by law. We reserve the right to change pricing with at least 30 days' notice communicated via email or in-app notification. Continued use of the Service after the effective date of a price change constitutes your acceptance of the new price.

Downgrading or cancelling your subscription takes effect at the end of the current billing period. You will not receive pro-rated refunds for unused time remaining in a billing period, except as described in our Refund Policy.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

Violate any applicable local, national, or international law or regulation;
Use data obtained through the Service to harass, threaten, or harm any individual;
Send unsolicited commercial messages to users identified through the Service;
Attempt to gain unauthorised access to the Service's systems or infrastructure;
Reverse engineer, decompile, or extract source code or AI prompts from the Service;
Use the Service to build a product or service that competes with OpinionDeck;
Resell, sublicense, or transfer your account access to any third party without our written consent;
Automate access to the Service in a way that places disproportionate load on our infrastructure.

We reserve the right to investigate and take appropriate action against violations, including suspending or terminating access.

7. User Responsibilities & Data Compliance

The Service surfaces publicly available data from third-party platforms. You are solely responsible for ensuring that your downstream use of any data obtained through the Service complies with:

The Terms of Service of the underlying platforms (e.g. Reddit, Hacker News);
All applicable data privacy laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA); and
Any sector-specific regulations applicable to your business.

OpinionDeck acts as a conduit — we do not own the underlying content and make no representations about your rights to use it for any particular purpose. If your use of the Service involves processing personal data of EU/EEA residents, you are the data controller and bear the associated compliance obligations.

8. Intellectual Property

The OpinionDeck platform, including its software, designs, AI models, prompts, workflows, algorithms, and all content created by OpinionDeck, is the exclusive intellectual property of OpinionDeck and its licensors, protected by copyright, trademark, trade secret, and other applicable laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes in accordance with these Terms. This licence does not include the right to sublicence, modify, or create derivative works.

You retain ownership of any content you bring to the Service. By uploading or saving content, you grant us a limited licence to process and store that content solely to provide the Service to you.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) AI-GENERATED ANALYSIS WILL BE ACCURATE, COMPLETE, OR RELIABLE; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED. USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OPINIONDECK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO OPINIONDECK IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) USD $50.

11. Termination

You may terminate your account at any time by cancelling your subscription and discontinuing use of the Service. Upon cancellation, your access continues until the end of the current billing period.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or if we decide to discontinue the Service in whole or in part.

Upon termination for any reason: (a) your licence to use the Service ceases immediately; (b) you remain liable for any outstanding charges; and (c) we may delete your data in accordance with our Privacy Policy. Sections 7–12 of these Terms will survive termination.

12. Governing Law & Changes to Terms

These Terms are governed by the laws of India, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

We may update these Terms from time to time. If we make material changes, we will notify you by email or by displaying a prominent notice in the application at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and OpinionDeck with respect to the Service and supersede all prior agreements and understandings.
